We, Speciality Restaurants Limited (hereinafter referred to as “Company”, “We”, “Us”, or “Our”), incorporated under the Companies Act, 1956 (CIN: L55101WB1999PLC090672), with its registered office located at Uniworth House, 3 A Gurusday Road, Kolkata, West Bengal, India - 70019 respects the privacy of any person who accesses or uses Our Website/Application (hereinafter referred to as “You” or “Your”) and is committed to protecting Your Information. This notice applies to the processing of personal data collected in digital form or any non-digital form which is digitised subsequently.

In order to comply with the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the rules framed thereunder and to nurture Our association, We would be collecting and processing Your Information. For this data collection and its processing, We need Your explicit consent.

You reserve the right to file a complaint with the Company regarding any grievances arising from the processing of Your Information, which shall be directed to the Grievance Officer, as detailed in Our Policy. Should the grievance remain unresolved through Our grievance redressal mechanism, You further retain the right to approach the Data Protection Board of India with a complaint, as outlined in the provisions of the DPDP Act. Pursuant to the DPDP Act, You are required to exhaust all opportunities of grievance redressal before approaching the Data Protection Board of India.

All the capitalised terms used in this Consent Notice shall have the same meaning assigned to them as in Company's Privacy Policy (“Policy”).

Declaration of Understanding - Data Processing Policies:

1. I understand that my Information may be collected only with my valid consent, and that it may be processed only in accordance with the Policy.
2. I agree to provide all information (collectively referred to as “Information”) mentioned below to the Company during the visit at Our restaurants, registration on Our Website or usage of Our Website or both, for better facilitation of Services, which includes, but is not limited to:
1. Personal Information such as name, contact details such as mobile number and email address, birthday and anniversary dates, billing and payment-related information such as mode of payment, transaction reference numbers, reservation and order details. Delivery address for takeaway/delivery orders, feedback, complaints, and service providers. Name and contact details of proprietors/authorised representatives; contractual and transaction-related information (if it relates to personal information regarding a person and not of the business itself); contractual and commercial interactions, including vendor, supplier, and service provider onboarding, contract execution, and payment processing.
2. Location and Log Information which shall include (i) IP addresses, (ii) Your geolocation information, (ii) time zone (iv) access dates and times, (v) information about Your activity on Our Platforms which shall include the sites from where You have accessed Our Platform(s) , (vii) type of browser, and (ix) mouse clicks, browser actions.
3. Usage and Preference Information i.e. how You interact with Our Services, and settings chosen. In some cases, We do this through the use of cookies, web beacons, tags and scripts, and other similar technologies including local storage objects such as HTML5 and other similar technologies that create and maintain unique identifiers.
4. Device Information like Your mobile device including for example operating system and version, software and file names, preferred language, IP address, geolocation information, unique device identifiers, browser type, browser language and other transactional information, etc.
5. Information shared through free will: We may collect additional information at other times, when You provide feedback(s), modify Your content or email preferences, respond to surveys, participate in contests or special offers, or asking Us a question through Our e-mail.
6. Market Research: We may collect personal information from You in connection with voluntary surveys conducted by Us. Data may be collected through the Platforms, on the phone or through the mail or at Our restaurant.
7. Local Storage Objects (LSOs) such as HTML5 to store content information and preferences. Third parties with whom we partner to provide certain features on Our site or to display advertising based upon Your web browsing activity use LSOs such as HTML 5.
8. Analytics, Logs and History such as internet protocol (IP) addresses (the region or general location where Your computer or device is accessing the internet), browser type, operating system and other usage information about the use of Platforms, including a history of the pages You view.
9. Other Information: Any content You choose to make public on Our Platform such as comments, reviews, ratings, images, or other submissions may be viewed and used by others and by Us for promotional or commercial purposes. We are not responsible for information You voluntarily disclose through such public activities, which may also appear on third-party websites or connected social media accounts and will be deemed shared by You. We may also collect personal information when You participate in contests, sweepstakes, or special offers; if You do not wish such information to be shared, please do not participate.
3. We collect, use, process, store, disclose or transfer Your Information in compliance with the Applicable Laws of India, for the following purposes to:
1. perform the Services that You have agreed with Us for, including but not limited to availing of Our Services, or access the content on the Platform(s) and in connection with other ancillary services on the Platform, including facilitating table reservations, walk-in dining, takeaway and delivery orders, gift vouchers, and related customer support and engagement;
2. maintain and operate internal business systems and records, including storage, maintenance and retrieval of records in physical and/or digital formats, and implementing role-based access and internal access controls;
3. undertake operational and business communications, including sending service communications and operational updates, and conducting brand communication and campaigns through authorised channels, including bulk WhatsApp messages or emails where undertaken for legitimate business purposes;
4. engage third-party service providers as sub-processors to support Our operations (including POS providers, reservation/ordering/delivery platforms, payment partners, IT/cloud vendors, customer feedback systems and professional advisors), to the extent necessary for the purposes described in this Policy;
5. manage relationships with vendors, suppliers, service providers and contractual counterparties, including onboarding, contract administration and payment processing;
6. ensure security of Our premises, personnel and operations, including through physical and digital security controls and, where applicable, CCTV-related security measures supported by third-party vendors;
7. provide an enhanced and personalised user experience;
8. analysis to improve customer relationships;
9. make suggestions and recommendations to You about Our Services that may be of interest to You by using Your email address and mobile number (by SMS or WhatsApp);
10. comply with contractual, legal or regulatory obligation;
11. manage customer communications, including responding to queries, feedback, complaints and service requests received through Our Platform, email or at Our restaurant premises; enhance other information, We have about You to help Us better understand You and determine Your interests and preferences;
12. development in products offered, which allows Us to improve and enhance the safety and security of Our Services, develop new features and products;
13. improve Website analytics, user experience, and optimize Our services;
14. check any account activity in order to prevent fraudulent transactions and ensure the security;
15. guarantee overall performance and administrative functions run smoothly; and
16. disclose purposes at the time You provide Your information or as otherwise set forth in this Privacy Policy.
4. I understand that I have certain rights that I enjoy as a data principal over my Information, in relation to its collection, use and processing. These rights, inter alia, relate to confirmation and access, correction and erasure, objection of processing, grievance redressal and withdrawal of consent. These rights are available to me in the manner set out in the Policy.
5. I agree that I am of lawful age to contract as per Applicable Laws of India and I have read and understood the processing requirement with respect to my Information as listed above and provide my free, specific, informed, unconditional and unambiguous consent to the above by signing on the space provided below.
6. I understand that I have the right to withdraw my consent at any time in the manner specified under the Policy. If I need to withdraw my consent with respect to usage of my Information under Company's purview, excluding data which has already been shared with the authorities, regulators or business associates and outside the control of the Company at that time, I will inform the Company through the “Consent Withdrawal Form” as provided on the Website.
7. I understand that this withdrawal of consent will be implemented as soon as practicable. I also confirm that the Company, while accepting my request for withdrawal of consent, will be allowed to keep such Information as required by the Applicable Laws and regulations for history and record keeping purposes for a specified period of time.
8.
